Terms of Service

1. Acceptance

These Terms of Service ("Terms") govern the use of ofinev.comand the purchase of products and services from Ofinev LLC ("Ofinev"), with offices at 3225 North Hiatus Road, Sunrise, FL 33345, United States, and C. Erik Leonard Ekman 34, Santo Domingo, Dominican Republic. By requesting a quote or engaging a service, you accept these Terms.

2. Services

• Custom software development: projects defined in a specific proposal or contract detailing scope, deliverables, schedule and price.
• Digital transformation consulting and cloud infrastructure & services consulting: advisory services billed by the hour or through engagements agreed in writing.
• Solution architecture based on automation and AI: architecture design engagements defined per project in the corresponding proposal or contract.
• Digital technology training: training programs priced per program according to duration and content.

3. Prices and payments

Prices published on the site are for reference and are expressed in US dollars (USD); the final price is confirmed in the corresponding quote or contract. Payments are processed through secure payment providers (Stripe) or bank transfer. Development projects may require an advance payment and milestone payments as set out in the contract.

4. Delivery

All deliverables (documents, roadmaps, source code, deployments) are delivered digitally according to the schedule agreed for each project or engagement. Ofinev does not sell physical products, so postal shipping does not apply.

5. Refunds and cancellations

Refund conditions are described in our Refund Policy, which forms part of these Terms.

6. Intellectual property

Unless otherwise agreed in writing, custom-developed code and deliverables are transferred to the customer once the total project price has been paid. The content of this site (text, brand and design) is the property of Ofinev LLC.

7. Warranties and limitation of liability

Ofinev warrants that its services are provided with the professional diligence customary in the industry. To the maximum extent permitted by law, Ofinev's total liability to the customer is limited to the amount actually paid for the product or service giving rise to the claim, and Ofinev is not liable for indirect damages or loss of profits.

8. Governing law

These Terms are governed by the laws of the State of Florida, United States. Any dispute shall be submitted to the competent courts of that state, without prejudice to any mandatory consumer-protection rules that may apply, including those of the Dominican Republic for purchases made there.
